1. Scope

18 U.S.C. §2257, 18 U.S.C. §2257A, and 28 C.F.R. Part 75 generally address age verification, record-keeping, and labeling obligations for certain visual depictions involving real human beings.

The service is an online platform that hosts works uploaded by users. This page explains the service’s general operating model and baseline position based on the types of works posted on the service.

2. Platform Role

The service operates as a platform that stores, transmits, displays, searches, and indexes user-submitted material. The service does not recruit performers, hire performers, direct filming, or participate in production for works uploaded by third parties.

Accordingly, in the ordinary course of operations, the service is not the original producer or performer-management entity for third-party submitted content, and mere hosting does not designate the service as the custodian of records for third-party works.

3. Works Without Real People

Most works posted on the service are creative or non-photographic depictions such as webtoons, manga, doujinshi, and illustrations that do not depict real human beings.

These works are generally outside the ordinary scope of 18 U.S.C. §2257, §2257A, and 28 C.F.R. Part 75, which are premised on record-keeping for visual depictions of real human beings.

4. Exceptional Content Featuring Real People

Exceptionally, third-party uploaded content featuring real adults may be posted. The service does not allow uploads of real-person content featuring minors.

If an uploader or original content provider submits material featuring real human beings, that submitter must confirm that every depicted person was at least 18 years old at the time of production and, where applicable law applies, must independently determine and comply with required record-keeping and notice obligations.

If an uploader provides a separate 2257 or 2257A notice for an individual work, that notice is treated as the uploader-provided work-specific notice for that work.

5. Uploader Responsibilities

  • When uploading material featuring real human beings, uploaders must independently verify whether legal record-keeping obligations apply to that material.
  • Where applicable, uploaders or original content providers must directly maintain age verification, records, work-specific identifying information, and any required notice language.
  • Uploaders must not upload real-person material featuring minors and must not provide false or incomplete compliance information.
  • The service does not replace legal advice for individual uploaders. Uploaders should obtain U.S. legal advice directly when needed.

6. Requests and Actions

The service may remove content, restrict access, request additional information, or take account action as needed under applicable law, the Terms of Service, the Copyright/DMCA process, and internal policies.

7. Changes
